This privacy notice is provided by Dr Emma Clarke and explains how your personal data is collected, handled, and processed when you visit my website (https://dremmaclarke.uk). It also outlines your privacy rights and how the law protects you, in accordance with the UK General Data Protection Regulation (UK GDPR).

Please read this notice in full along with my Confidentiality and Privacy notice so you understand how and why your data is used.

I, Dr Emma Clarke, am the data controller responsible for your personal data. I am registered with the Information Commissioner’s Office (ICO), registration number ZB866860. You can find more information about the ICO here: https://ico/org.uk.

Any data I hold is processed in accordance with the Data Protection Act 2018 and the UK GDPR. I also comply with the standards set by the Health and Care Professions Council (HCPC).

Personal data categories

Personal data is any information that can identify an individual. When you use my website, the following types of personal data may be collected:

  • Identity Data: e.g. first name, surname (typically collected via the enquiry form).
  • Contact Data: e.g. email address, phone number, or mailing address.
  • Transaction Data: e.g. payment records for services (please note: I do not collect or process bank or card details; payments are made via bank transfer).
  • Technical Data: e.g. IP address, browser type and version, operating system.
  • Usage Data: e.g. how you use the site, typically collected via server logs and cookies.

  • Use the website enquiry form (submitting Identity and Contact Data).
  • Communicate with me via phone, email, post, or in person.
  • Enter into a therapeutic contract with me.

2. Automatically

When you:

How your personal data is used

I take your privacy very seriously and will only use your personal data when the law permits me. These are the potential reasons I may collect and process your personal data:

  • Replying to contact from you – if you contact me using the website enquiry form, in the process of responding to you I will need to use your personal data. Please be aware that by submitting an enquiry form, you are providing consent for me to contact you via the email address you provide; this is detailed clearly on the website.
  • Business and service administration – I will use your personal data when carrying out actions necessary for the implementation of my services, such as organising phone calls and appointments, sending invoices and processing payments.
  • Legal obligations – I may use your personal data when I need to comply with any legal or regulatory obligations such as crime or harm prevention.

I may also use personal data which you provide via the website (where I have a lawful basis to do so) when it is necessary for my legitimate interests, third party interests, or your interests, and fundamental rights do not override those interests.

It is important that the personal data I hold about you is accurate and current and as such I ask that you keep me informed if your personal data changes during your engagement with me.

I do not share your data with third parties for marketing purposes.

Data Security

I take appropriate measures to secure your personal data and prevent unauthorised access. If data is shared in line with this policy, I ensure safeguards are in place.

In the event of a data breach, I follow ICO guidance and will notify you and the relevant authorities as legally required. Please note: while I do my best to secure data, no transmission over the internet is 100% secure. Using the site is at your own risk, and I encourage you to protect your own information when online.

Data retention

Any personal data I have recorded or that is contained in documents given to me by you, will be retained only for as long as necessary to fulfil the purposes I collected it for, including satisfying any legal, accounting, or reporting requirements. To determine necessary and suitable retention periods for personal data I will consider the amount, nature and sensitivity of personal data, any potential risk relating to unauthorised use of your data, and any applicable legal obligations.

Personal data that is collected and used during the course of any therapeutic services I offer you will be kept in accordance with the practice guidance set out by the British Psychological Society which you can find here Practice Guidelines | BPS – British Psychological Society. Your rights

Unless subject to an exemption under the UK GDPR, you have the following rights with respects to your personal data:

  • The right to request a copy of your personal data, known as a “data subject access request”. You can do this free of charge at any time you wish. This enables you to receive a copy of the personal data I, Dr Emma Clarke, hold about you and to check I am lawfully processing it.
  • The right to request correction of the personal data that I hold about you. This enables you to have any incomplete or inaccurate data that I hold about you corrected, although I may need to verify the accuracy of the new personal data that you provide me with.
  • The right to request that your personal data is erased. This enables you to ask me to delete personal data where it is no longer necessary for I, Dr Emma Clarke, to retain this data. You also have the right to ask me to delete your personal data where you have successfully exercised your right to object to processing, where I may have processed your personal data unlawfully or where I am required to erase your personal data to comply with local law. Please be aware I may not always be able to comply with your request for deletion for specific legal reasons, which I will communicate to you at the time of any such request where applicable.
  • The right to request that I provide you with your personal data in a ‘structured commonly used and machine-readable format’. Note that this right only applies to automated information which you initially provided consent for me to use or where I used the information to perform a contract with you.
  • The right to request restriction of processing of your personal data. This enables you to ask me to pause processing of your personal data: (a) if you want me to establish the data’s accuracy; (b) where my use of the data is unlawful but you do not want me to  delete it; (c) where you need me to hold the data longer than required as you need it in relation to legal claims; or (d) where you have objected to my use of your data but I need to establish whether I have legitimate and overriding grounds to use it.
  • The right to object to processing of your personal data, in limited circumstances. For example (but not limited to), where you object to the processing of your personal data because you feel it impacts upon your fundamental rights and freedoms. Please be aware that I may still have legitimate reasons to process your personal data which override your rights and freedoms.
  • The right to withdraw consent at any time where I am relying on consent to process your personal data. This will not affect the legality of any processing of your data that was carried out before you withdrew consent. Please be aware that if you withdraw your consent, I may not be able to provide certain services to you and will advise you of this at the time you withdraw your consent. 

If you wish to exercise any of your above rights, please send a written request to me at contact@dremmaclarke.uk, addressed for the attention of the ‘data protection controller’. Such a request is free of charge. However, I may charge a reasonable fee, or refuse to comply with your request, if your request is clearly unwarranted or excessive. 

If you do make such a request, as a security measure I may need to request specific information from you to help confirm your identity and ensure your right to access your personal data. I may also contact you to ask you for further information in relation to any requests. I will try to respond to all requests within one month, but it may take me longer than a month if your request is particularly complex or you have made several requests. Should it be likely to take longer than one month, I will communicate this to your directly.

My website may contain links to other websites, plug-ins and applications. Clicking on those links may allow third parties to collect or share data about you. I do not have control over third party websites and am not responsible for the availability of their privacy notices. I am unable to check or monitor the accuracy of any content included in third party websites; where I have provided links to other websites, this does not automatically imply endorsement by me of the content in this website.

If you decide to access third-party websites, plug-ins and/or applications via my website, you do so at your own risk.  I encourage you to read the privacy notice of every website you visit.
